Maple Leaf Foods (Listeria contamination)

 

If you or a family member were affected by consuming recalled Maple Leaf meat products in 2008, you can submit a compensation Claim Form to the court-appointed administrator. The deadline for filing your claim is:

Stevensons LLP, together with other leading Canadian law firms, acts for the plaintiffs in coordinated class action lawsuits brought against Maple Leaf Foods Inc. and Maple Leaf Consumer Foods Inc. for the distribution in 2008 of meat products contaminated with the potentially deadly bacteria Listeria Monocytogenes.

We are pleased to report that courts for all jurisdictions in Canada have approved a settlement negotiated by class counsel. The Notice of Settlement Approval was published nationally on May 9, 2009.

Justice Perell of the Ontario Superior Court of Justice has declared the settlement agreement "fair, reasonable, and in the best interests" of persons affected by this tragedy. Justice Perell's Reasons for Judgment were released on March 9, 2009, followed by similar decisions in the other courts.

Under this settlement the defendants will pay between $25 and $27 million in full satisfaction of individual claims, subrogated claims by provincial health insurers who paid for victims' medical care, class counsel fees and expenses, and administration and related costs. Victims whose claims are approved will receive compensation on a grid corresponding to their level of injury or loss. For details see the Settlement Agreement or the Compensation Grid.
