Hyundai (Certain Subframes for 1999-2004 Models)

This class action involved a claim against Hyundai in respect of allegedly improperly designed and manufactured subframes.  The action was resolved when Hyundai issued a recall (Transport Canada Recall #2009123) and agreed to pay certain reimbursement expenses.

Colin Stevenson and Harvin D. Pitch are lead counsel acting for the plaintiffs in an action against Hyundai Motor Corporation and Hyundai Auto Canada Corp. The claim against Hyundai includes the allegation of improperly designed and manufactured Hyundai Sonata sub-frames for models 1999 to 2004. (See the issued claim here.) The claim alleges that as a result of the deficiency in the sub-frame design which proved to be unusually vulnerable to premature corrosion and consequently, structural deterioration, the vehicle becomes structurally unsafe and creates a danger to the operator and occupants. A similar claim to this claim against Hyundai was issued in the United States District Court.

Consequently, Hyundai had issued a recall in the United States and in Canada with respect to Hyundai Sonata sub-frames for models 1999 to 2004. For particulars of this recall in Canada please visit Transport Canada website at www.tc.gc.ca and referencing “Transport Canada Recall # 2009123”.

For people who own and/or have previously owned 1999 to 2004 Hyundai Sonata vehicles and have spent money to replace the sub-frames, if you would like to know whether you are entitled for reimbursement of out of pocket expenses, please check with Transport Canada and/or contact Sonia Pillitteri at SPillitteri@teplitskycolson.com or Brian Kirkland at bkirkland@stevensonlaw.net.
